I believe the answer is: Preexisting conditions may not be excluded under policy replacement regulations.

Depending on the severity or the chance of the preexisting conditions from re-occuring, they can be excluded under policy replacement regulations. Insurance company does this to protect their financial interest against customers who already sure that they are going to be eligible for the insurance/
